If you own and operate a business the way that the asset will be treated in your divorce is going to be dependent upon whether or not the business is marital property or separate property. If its marital property, it will be distributed via equitable distribution. In some instances the court might even appoint a valuation company to determine a monetary value of the business. But you know there really is no cut and dry answer, each circumstance is different and the determination of whether something is straight right marital property, or partially separate property has to be evaluated on a case-by-case basis.
